Resumen:
Teniendo encuenta que es de reciente elaboración el reconocimiento que de manera formal se ha venido integrando en las diferentes Constituciones del mundo, el derecho al medio ambiente, su derecho a disfrutarlo, no ha dependido precisamente a la positivización que de este se ha hecho, toda vez que la especie humano, de manera general y de manera particular cada individuo, se ha preservado gracias a un medioambiente adecuado.
Hasta hace poco no existía, ningún tipo de reparo, ni exigencia y mucho menos tutela para el ejercicio de este derecho, pues como se ha dicho, éste se ejercía con toda naturalidad y libertad, era connatural a cada ser vivo. Ahora bien, es necesario entonces entrar a considerar la importancia que se le ha dado - sobre todo a mediados del siglo XX- a su incorporación en laregulación constitucional de la mayoría de las naciones, lo cual puede significar que estamos en riesgo de no poder seguir disfrutándolo sin que ello implique no solo un derecho, sino que va más allá y se constituya en un derecho deber.
Lo anterior quiere decir entonces, que el disfrute del derecho al medio ambiente desde la perspectiva de la regulación constitucional, no está orientado demanera exclusiva, a asegurar su disfrute, sino que además debe contener garantías diversas y efectivas. Vale decir entonces, que cada estado asume su compromiso en procura de crear y garantizar los mecanismos para el cuidado del medio ambiente equilibrado o sano, del cual se deriva toda posibilidad de vida y en tal sentido por conexidad, habría constituirse un derecho fundamental1 de la personareconocido constitucionalmente en la mayoría de los países del mundo, por ello, debe ser estrictamente respetado.

ABSTRAC

That is to say then, that each state takes its commitment and seeks to create mechanisms to ensure care or healthy balanced environment , which is derived from the possibility of lifeand in that sense by connectedness , would constitute a fundamental right of the person constitutionally recognized in most countries of the world , therefore, must be strictly respected .
