CASO PRÁCTICO

En el expediente N° 3259-2004 seguido por Emilia Ccahuantico Suárez (demandante) en representación de su menor hijo ElmerHuamaní Ccahuantico contra Julio Huamaní Casavilca (demandado) por proceso de alimentos; una vez admitida la demanda y corrido traslado al demandante, éste en un afán de colaboración con la administración de justicia, adjunta a la contestación de la demanda su tarjeta del Banco de la Nación para que la demandante pudiera cobrar el efectivo que disponga el juzgado en su sentencia; siendo ello así, yllevada a cabo la audiencia única, se dicta sentencia dentro de los plazos establecidos por el Código Procesal Civil, la cual falla declarando fundada la demanda en parte otorgándose la suma de S/. 400.00 Nuevos soles por alimentos a la demandante, empero, cuando la misma fue al local de juzgado para que, junto con la tarjeta del demandado, pudiera hacer efectivo el cobro, se dio con la sorpresa...
