INTRODUCCION.
Las ejecuciones extrajudiciales y sumarias que miembros de La Fuerza Pública y grupos armados realizan con el apoyo de funcionarios Estatales han obligado a la población civil y a las organización N´gubernamentales a organizarse para enfrentar este flagelo, lo cual en un comienzo no fue aceptado por los gobiernos de turno, involucrarse de manera indirecta en estos hechospor su grave omisión en aras de evitar la impunidad y la no repetición de estos homicidios agravados.
Lo anterior llevo a la comunidad internacional mediante presión política a obligar a El Estado Colombiano ha realizar verdaderos cambios en la política de justicia que evitara la impunidad, así como prevenir al máximo la repetición de la violaciones de derechos humanos materializadas endesapariciones forzadas y asesinatos extrajudiciales, sumarios y arbitrarios, conceptos traídos por la jurisdicción internacional, pero que han tenido diferentes interpretaciones en el ámbito nacional
Sin tratar de desviarme del tema, ordenado explicare en forma sucinta como esta errónea interpretación de los crímenes cometidos han facilitado a la clase política y el mando militar comprometidoindirectamente en estos delitos, el eludir a la justicia, la cual solo castiga a los autores materiales de los presuntos hechos, mostrándose en un 40 % de los juicios; que se llegan a una sentencia condenatoria, son gracias a las violaciones tajantes del debido proceso de los sindicados, quedando el vacío jurídico que nos puede indicar que no todos los condenados por los asesinatos extrajuduciales,sonlos verdaderos culpables de estos crímenes.
En complemento con lo anterior es de importancia relacionar La Legítima Defensa Institucional, la cual es aceptada por Naciones Unidas, pero que en el territorio nacional, no han sido debatidos en los juicios, los cuales nos ayudarían a determinar todos los culpables de estos hechos.
Introduction
The executions that the members of the publicforces and armed groups made with the help of state workers have obligated to the population and the nongovernmental organizations to organize for dealing with this problem, which in the beginning was not very accepted by the turn, govern; to get involved in an indirect way in these facts for the omission for avoiding the impunity and for not repeating these serious murders
This took to theinternational community with some pressure from politicians to obligate to Colombia to make real changes in the justice politics that could avoid immunity so as preventing the repeating of the violations of the human rights ,given in forced disappearing and extrajudicial murders, concepts brought by the international jurisdiction but those have had different meanings in thenational environment.
Without dissuading from the main topic I’ll explain in a succinct way how this bad interpretation of the murders committed have made the things easy to the political class and the army bosses indirectly compromised with this murders, avoiding justice which just punishes the material authors of the crimes showing in a forty percent of the cases that the sentences are violatedby the real authors of the crimes; that indicates the way that not all the reprobates of the crimes are guilty.
As a complement, it is important to relate the institutional legitimate defense which is accepted by the UN, but that in the national land has not been debated in different stages of the law’s system; which will help us to find out all the reprobates
