Unidad 11: HIPÓTECA (3108).
DEFINICIÓN LEGAL: dcho real constituido en seguridad de un crédito en dinero, sobre los bs inmuebles, que continúanen poder del deudor.
CARACTERES ESENCIALES: Dcho Real: Por lo dispuesto en el art. 3108 y en el art. 2503 inc. 5º CC.
Accesorio: dcho real accesorio de un dcho personal que debe consistir en un crédito en dinero. (Art. 524CC.) No puede existir hipoteca sin crédito al cual garantice. Art. 3187 “la hipoteca se extingue por la extinción total de la obligación pcipal, sucedida por alguno de losmodos designados para la extinción de las obligaciones”.
Convencional: se perfecciona con el acuerdo entre las partes.
