Huelgas disposiciones generales
COMENTARIO: La huelga es un derecho social económico cuyo ejercicio le permite a los trabajadores alcanzar mejores condiciones de trabajo, prestaciones y salarios, yel porvenir sus reivindicaciones sociales.

La huelga legalmente existente siempre a sido una figura jurídica reconocida como tal por los atributos del trabajo; la definición legal de la misma, enconcordancia con el articulo 929, precisan su significado jurídico y social en el sentido de que si dentro de las setenta y dos horas siguientes a la suspensión del trabajo no se promueve ladeclaración de inexistencia, la huelga se considera existente para todos los efectos legales, sin declaración de ninguna especie, como ocurre cuando no se dicta resolución sobre registro de sindicatos dentro delos terminos de la ley, es decir, la huelga se tiene por existente ipso jure.

CAPITULO I
DISPOSICIONES GENERALES
ARTICULO 440. HUELGA ES LA SUSPENSION TEMPORAL DEL TRABAJOLLEVADA A CABO POR UNA COALICION DE TRABAJADORES.
ARTICULO 441. PARA LOS EFECTOS DE ESTE TITULO, LOS SINDICATOS DE TRABAJADORES SON COALICIONES PERMANENTES.
ARTICULO 442. LA HUELGA PUEDE ABARCAR AUNA EMPRESA O A UNO O VARIOS DE SUS ESTABLECIMIENTOS.
ARTICULO 443. LA HUELGA DEBE LIMITARSE AL MERO ACTO DE LA SUSPENSION DEL TRABAJO.
ARTICULO 444. HUELGA LEGALMENTE EXISTENTE ES LA QUE SATISFACELOS REQUISITOS Y PERSIGUE LOS OBJETIVOS SEÑALADOS EN EL ARTICULO 450.

ARTICULO 445. LA HUELGA ES ILICITA:
I. CUANDO LA MAYORIA DE LOS HUELGUISTAS EJECUTEN ACTOS VIOLENTOS CONTRA LAS PERSONAS O LASPROPIEDADES; Y
II. EN CASO DE GUERRA, CUANDO LOS TRABAJADORES PERTENEZCAN A ESTABLECIMIENTOS O SERVICIOS QUE DEPENDAN DEL GOBIERNO.
ARTICULO 446. HUELGA JUSTIFICADA ES AQUELLA CUYOS MOTIVOS SONIMPUTABLES AL PATRON
ARTICULO 447. LA HUELGA ES CAUSA LEGAL DE SUSPENSION DE LOS EFECTOS DE LAS RELACIONES DE TRABAJO POR TODO EL TIEMPO QUE DURE.
