Revocation of administrative actions, public interest and
legal security

Resumen: Las decisiones administrativas deben sujetarse al interés público
no solo al momento de su aprobación sino durante su vigencia, por lo que se
hace necesaria una institucióncomo la revocación. Sin embargo, la existencia
de la potestad revocatoria de actos administrativos conduce a la afectación de
la seguridad jurídica, debido al efecto expropiatorio que tiene sobre derechos
y situaciones jurídicas, con lo que se torna necesaria la búsqueda de formulas
conciliadoras. En tal contexto, el presente artículo, además de brindar importantes alcances conceptuales, buscaidentificar los requisitos para la revocación del acto administrativo, ahondar en su estructura operativa, distinguir
las clases de revocación existentes y señalar sus diferencias con otras figuras,
como la nulidad, la caducidad, entre otras.

Abstract: Administrative decisions should be submitted to public interestnot
only upon its approval but during its effect, therefore it is necessary the existence of an institution as the revocation. However, since revocation power
of administrative acts affects legal certainty (due to its effects on rights and
legal situations) the search of conciliatory formulas became a need. In such
context, this article not only provides important conceptual scopes but seeks
toidentify the requirements for revocation of administrative act, go deep into
its operative structure, distinguishes types of revocation and to point out its
differences with other legal concepts such as nullity, expiration among others.
