Marijuana and the law
Michael Maynard was a dedicated, hard working teacher. He had been employed at Bloom Township High School, outside Chicago, for almost two years. He had a natural ability to understand teenagers and a reputation among the faculty formotivating his students. He loved his job, and his students loved him. Then, on the eve of winter break in December 1995, he was fired. Here’s why.
Michael had been arrested in 1974 for possession of less than half an ounce (10 grams) of marijuana. In 1974 Michael was a 20 years old college student and like many students of the time, he says that some times he smoked “pot”. He had been involved in aminor traffic accident, and when the police searched his car they found a small plastic bag of marijuana. He said he was guilty and paid a fine of $100. The situation was so minor that Michael forgot that ever happened.
In 1979, the state if Illinois passed a law designed to protect schoolchildren from convinced criminals. The law was expanded in 1985 to require that school check the background ofits teachers. The law says that school must fire any teacher who has committed a crime including minor drug offenses.
Even though Michael is not allowed to appeal the decision (the law does not permit appeals) he has chosen to fight back. With the help of a lawyer, he is trying to have the 1985 Illinois law rewrite and he can get his job back.
