Resumen de los Hechos
La presente sentencia tiene como puntos más importantes los siguientes:
Se interpone una demanda de inconstitucionalidad interpuesta por diez mil seiscientosnueve, contra el artículo 1º de la Ley Nº, 28704 que modifica el artículo 173º, inciso 3º, del Código Penal. En la cual alegan que dicho contraviene a nuestra Carta Magna, por limitar el derecho a la “libertad sexual” de los adolescentes, ya que si bien los demandantes reconocen que se debe dar todo el peso de la ley a las relaciones sexuales realizadas con violencia, coerción o aprovechamiento deuna posición dominante y más aun si se trata de adolescentes y niños. Sin embargo cuestionan que si el estado busca proteger sus derechos, no debe penalizar la relación sexual si esta ha sido sostenida con el consentimiento del menor, porque aquí no habría riesgos por ser un ejercicio libre de su sexualidad el cual es un derecho fundamental.
