CONTAMINACION DE EVIDENCIA.
RESUMEN
Las evidencias, la cual constituyen la base científica-técnica para la comprobación del cuerpo del delito o del hechos, se van jerarquizando mediante un proceso de ajuste a fin de que constituyan medios de prueba que nos permitan conocer e individualizar lapersona inculpada de todos los demás, reuniendo sistemáticamente y científicamente tales elementos de convicción.
La importancia de esta ciencia es la de contribuir al esclarecimiento de los hechos mediante técnicas de las más variadas para el conocimiento del hecho delictuoso. La razón de ser de la evidencia, es la de descubrir y comprobar hechos. La primera significa poner endescubierto el hecho, su agente y sus circunstancias y poderlo llevar a la instancia judicial.
Cuando la evidencia llega a una instancia judicial es tomada como indicios de un hecho presuntamente delictivo. A esta razón de ser se le considera como su característica primordial y se centra en la búsqueda de las pruebas, el seguimiento de pistas y el descubrimiento de evidencias necesarias para terminarcon éxito los objetivos propuestos.
Es decir la de comprobar la verdad de los aducido ajustándose la causalidad de lo sucedido, recae naturalmente sobre el cuándo, cómo, dónde y quién es decir sobre las circunstancias del hecho; evitándose así el error judicial. De allí que descubrir es comprobar o llegar a la demostración científica policial del delito y es distinta a la anterior auncuando se halla íntimamente ligado a ella.
La primera razón es científicamente metódica y experimental, la segunda pretende una reconstrucción causal y solo en los casos en que se da en todas sus partes o en los que se estima procesalmente suficiente, puede el juez tomarlo en cuenta por ser la generadora de la evidencia probatoria.
