Of Course that I would take the case, The ethical problem here is that the company that I am going to defend started to be involved in the illegal behavior, and now it is a victim of the crimethat it was started by both.
I would take the case, not only for winning, and give money back to the company that it is requiring my services, I would do it to unveil to the press the kind of tricksthat companies uses in order to avoid the payment of taxes.
It is bad enough that companies in this country are abusing of the law, and doing tricks in order to avoid a penny or two, which will resultin paying less and less to workers, they haven’t realized that in the end thanks to them they are propsperating.
It is common that now companies will hire a third-party human resources company inorder to deal with employees and avoid any extra compensations (desserved by employees) they do this aoutside the law, and even though that this is been trying to be regulated, fact is that a lot ofcompanies out there are still trying to get away with it.
Back to the case of study, this is why I would do it, I would do to expose how both agreed to work under the law, and how this kind ofrelationships sooner or later will affect one of them, in this case the company that it is accusating, maybe will have proof of how the accused company used legal resources in order to avoid the law, but howclean a company that agrees to work under the law will be?
It will be important as well to determine which kind of job they were doing together, because if it was an illegal work, my defendant will beas well prosecuted by the law, because as I said, it is bad enough to work under the law, but if like in this case they were doing something under the table, we will have to see how wrong that is.It is important as well to prove, that working outside the law, and do activities such as avoid a bank to pay the payroll in order to avoid taxes or to avoid the payment of the social security wage,...
