PLANTEAMIENTO DEL PROBLEMA:
Determinar si la declaración de la nulidad de un asiento de dominio enerva la legitimación de un asiento posterior de dominio.
ARGUMENTOS DEL REGISTRADOR:
Que a consecuencia de una sentencia de nulidad de acto jurídico y de cancelación deinscripción , los mismos que han sido debidamente registrados , se afectaría las transferencias posteriores por inexactitud frente al titular del dominio y contradicción de derechos del tracto sucesivo, los mismos que deberán ser resueltos vía aclaración por parte del órgano judicial con jurisdicción competente.
