1. La Cosa Juzgada: Concepto

Diversos autores lo definen como:

Calvo Baca: es la autoridad y la fuerza que la Ley atribuye a la sentencia resuelta en juicio contradictorio.
* La Roche: es la autoridad y eficacia que adquiere una sentencia por haber precluido, sea por consumación o falta de actividadoportuna de los recursos que contra ella concede la Ley.
* Chiovenda: el bien juzgado se convierte en inatacable; la parte a la que fue reconocido, no sólo tiene derecho a conseguirlo prácticamente frente a la otra, sino que no puede sufrir ésta ulteriores ataques a éste derecho y goce (autoridad de la Cosa Juzgada), salvo raras excepciones en que una norma expresa de la ley disponga cosa...
