CONCLUSIONES.
ABSTRACT: In the investigation about the Roman Law, it’s essential the study,
examination and reflection of the great variety of written text concerning Roman
Law that has come down to us, with all the difficulties that it represents. The
studious will have to consider a series of elements:testimonies, archaeological rest,
ideology of the moment... which in many occasions will be essential to know the
real meaning of the ancient texts. It is necesary to initiate the investigations with a
cientific and faultfinding attitude, since the authors not always reflected in their
writings a truth which must be accepted like inquestionable. In adition, in many
occasions, we have received the textsretouched, written up of a form that was not
the original one, with gaps, added, cuts or modifications. In spite of the shortage of
juridica literatura, and considering its great initial production, we have the sufficient
one to have a good view of the classical Roman Law. In this article we have tried
to give a general point of view of the problems that appear to the romanist when
theyhandle the Roman Law sources. We will deal the problem of interpolations
determining a guideline that allow the discovery in the texts. Finally, we’ll study, as
a example, a series of fragments of Publio Juvencio Celso. Metodological criteria
will help in the scientific study of Roman Law, but do not forget that the good

making and the good sense of the investigator should prevail to obtain accurate
conclusions.

I.INTRODUCCIÓN
En cualquier investigación relacionada con documentos escritos es necesario
tener en cuenta el carácter histórico de las fuentes, ya que setrata del estudio de
textos antiguos con todas las dificultades que ello representa. Cuando el romanista
se enfrenta a un texto ha de tener en cuenta una serie de asuntos ajenos al mismo
pero en contacto intrínseco con él. Así, habrá que tener en cuenta los testimonios de
la época, restos arqueológicos, la mentalidad e ideología del momento, otros
escritos...
Respecto a estos elementos esnecesario adoptar una actitud científica, crítica y
por tanto, siempre en una línea escéptica, ya que es un hecho aceptado por la
doctrina que los autores de la antigüedad no siempre reflejaban en sus escritos una
verdad que haya de ser tenida como incuestionable, llegándonos sus textos, en
ocasiones, redactados de una forma que no era la original, con lagunas, añadidos,
recortes,modificaciones… Es necesario obrar con cautela, abordando los distintos
fragmentos con un sentido objetivo y realista.
El periodo clásico duró más de doscientos años1. Sus inicios coincidieron con el
advenimiento del principado, su final con el comienzo del derrumbamiento del
mismo, sobre la mitad del siglo III d. C. Es el periodo mejor conocido de la historia
del Derecho romano a causa de que se haconservado una parte importante de su
inmensa producción literaria en contraste con la escasa de la precedente época
republicana2.
