ANÁLISIS DE LA LEY ORGÁNICA DE CIENCIA TECNOLOGÍA E INNOVACIÓN RESUMEN
La Constitución de la RepúblicaBolivariana de Venezuela atribuye al Estado Venezolano el deber de reconocer, con carácter de interés público, la actividad de Ciencia, Tecnología, Conocimiento e Innovación y sus aplicaciones, como instrumentos fundamentales para el desarrollo económico, social y político del País, para la seguridad y soberanía nacional. En cumplimiento del mandato Constitucional, fue promulgada el 03 de Agosto de 2005 laLey Orgánica de Ciencia, Tecnología e Innovación, que reformó parcialmente el Decreto con Rango y Fuerza de Ley Nº 1290 de Ley Orgánica de Ciencia Tecnología e Innovación del año 2001, modificando sustancialmente el aspecto relacionado con la percepción de recursos para el financiamiento de las actividades objeto de regulación, dándole un giro al procedimiento para imprimirle visos de tipotributario. Ambos instrumentos coinciden en desarrollar la competencia del Estado en el fomento y coordinación de la investigación científica y tecnológica, y a tales fines, establecen las normas y principios que organizan el Sistema Nacional de Ciencia, Tecnología e Innovación, que tiene como propósito estructurar en el mismo a todos los actores que de una manera u otra tienen participación en lasactividades científicas y de desarrollo, y constituirse así en vínculo entre la comunidad científica, los agentes sociales y el Estado, responsable de programar la actividad científico-tecnológica, y de que los objetivos de esa programación estén acordes con las políticas para su implementación, que a su vez deben adaptarse a los intereses y necesidades sociales. ANALYSIS TO THE STATUTORY LAW OF SCIENCE, TECHNOLOGY AND INNOVATION ABSTRACT
The Constitution of the Bolivarian Republic of Venezuela attributes the Venezuelan State the obligation of recognizing, in the role of public interest, the activity of Science, Technology, Knowledge and Innovation, and their applications, as primary instruments forthe economic, social and political development of the country, for the national security and sovereignty. In fulfilling the Constitutional mandate, was promulgated on August the third of 2005 the Statutory Law of Science, Technology and Innovation, which partly reformed the Decree with rank and force of law number 1290 of Statutory Law of Science, Technology and Innovation of the year 2001,modifying substantially in the aspect to be related with the perceive of resources to finance the activities object of regulation, given a new course to the procedure to transmit feature of tax type. Both instruments coincide in developing the state’s competence in the encouragement and coordination of the scientific and technological investigation, and, in that purpose, establish the rules andprinciples which organize the National System of Science, Technology and Innovation, that has as a purpose structuring inside it all the protagonists that, in a way or another, have a participation in the scientific and development activities, and constitutes themselves as a link between the scientific community, the social agents and the State, responsible for the programming of theScientifictechnological activities, and the objectives of that programming agree with the policies for their implementation, that in turn, must adapt itself to the social interests and needs.
