El contrato de management en las transaccionescomerciales

RESUMEN

El presente trabajo ha sido elaborado cumpliendo con los objetivos trazados. En el primer capítulo, se hace el planteamiento del problema, describiendo todos sus elementos que tiene dicho capítulo. En el segundo capítulo, desarrollamos todo el marco teórico, describiendo de lo que dice la doctrina o los tratadistas con respecto a este contrato de management, describiendo lasdisposiciones generales sobre los contratos de comercio, luego se aborda el contrato de management en todas sus aristas, iniciando por su etimología, su evolución, sus definiciones, la naturaleza jurídica, las partes contratantes, sus derechos y obligaciones, las ventajas, los tipos de management, así como las diferencias con otros contratos. También se explica qué son las transacciones comerciales, parapoder entender en qué consiste lo ventajoso del contrato de management. Cabe resaltar, que si bien es cierto es un contrato que no tiene una regulación propio en nuestro país es muy uso, dando una utilidad a todos cuanto lo utilizan, aportando más beneficios en una buena aplicación.
En el capítulo tercero y cuarto, es ya propiamente dicha la tesis, son mis aportes y mis sugerencias sobre el tema dela presente tesis.

ABSTRACT

This paper has been prepared in compliance with the objectives. In the first chapter, is the approach to the problem, describing all the elements that have such a chapter. In the second chapter, we develop all the theoretical framework, describing what he says the doctrine or treatise on this management contract, describing the general provisions on contracts forthe trade, then deals with the management contract in all its edges, starting with its etymology, its development, its definitions, the legal, contracting parties, their rights and obligations, benefits, types of management, as well as differences with other contracts. It also explains what are the business transactions, in order to understand what the advantages of contract management. Notably,although that is a contract that has no regulation in our own country is very use, giving a value to all the terms used, providing more benefits in a good application.
In the third and fourth chapter, is the thesis itself, and my contributions are my suggestions on the subject of this thesis.
