III. Information about Your Eligibility This sheet provides information based on the answers that you gave during your CitizenshipWorks interview. It is provided for informational purposes only and it should not be included with your application if you decide to file fornaturalization with U.S. Citizenship and Immigration Services. The information on this sheet is not legal advice. You should consult with an attorney or BIA accredited representative to discuss the details of your eligibility for naturalization. A BIA accredited representative is someone who is specifically authorized by the United States government to help complete immigration applications, like thenaturalization application. All BIA accredited representatives work at nonprofit community agencies. Based on the answers that you gave during your CitizenshipWorks interview: • You have indicated that you have not always filed your U.S. tax returns. If a person applies for naturalization, USCIS will consider whether the applicant has always filed her tax returns when she was supposed to. For moreinformation about tax requirements, please see Section I under General Information about Naturalization below. There are many requirements that you must meet in order to qualify for naturalization. There are benefits to becoming a U.S. citizen, but for some people, there are also risks to filing an application for naturalization. These risks include being denied naturalization, losing the green card,and even being deported. Please read the following “General Information about Naturalization” and speak with an attorney or BIA accredited representative if you have any questions or concerns about your eligibility for naturalization. IV. General Information about Naturalization Applying for naturalization is one step towards becoming a U.S. citizen. There are many things you must show and do inorder to become a U.S. citizen. Not every person who files an application for naturalization will be approved for U.S. citizenship. For some people, applying for naturalization is a risky process because you could end up being denied naturalization and even deported from the United States. A. Age Requirement In order to apply for naturalization, you must be at least 18 years old. If you are not atleast 18 years old, you cannot apply for naturalization, but if you have at least one U.S. citizen parent, you may still qualify for citizenship through a process called “Derivation of Citizenship.” Your eligibility for derivative citizenship will depend on many factors, including whether

or not you have a green card, whether you are living with or lived with your U.S. citizen parent(s), yourparent’s marital status, and other information. B. Basis of the Application In general, there are four different ways to qualify for naturalization. 1) You must show that you have been a lawful permanent resident for at least 5 years. In this case, you do not have to be married to a U.S. citizen. In order to tell how long you have been a lawful permanent resident, you should check the date on yourgreen card. This is the date you became a lawful permanent resident. You can file your application three months early, at least 4 years and 9 months after the date on your green card; or 2) You must show that you have been a lawful permanent resident for at least 3 years; that you have been married to and living with your U.S. citizen spouse for at least 3 years; and that your U.S. citizen...
