Legalizing Gay Marriage: A Step Forward Reaching Development

C. (T.S) Costa Rica should legalize gay marriage in order to restore people’s human rights and guarantee the constitutional issues that marriage implies even though the Costa Rican catholic state bans it.

II. (T.S) Costa Rica must respect the UniversalDeclaration of the Human Rights (UNDHR) by legalizing gay civil unions with the aim of guarantee to its citizens the right to be recognized as an individual and to be treated equally.

C. (S.S) While homosexuals deserve unalienable human rights, the Costa Rican constitution is the only responsible for not assuring those by enactingpolitical laws to reform its “veto” constitution so that homosexuals can constitute families through marriage.

III. (T.S) Homosexual citizens must receive entire constitutional rights in order to acquire the legal benefits and obligations given through legal unions by legalizing gay marriage.

C. (S.S) Although some authorities are in agree to legalize gay marriage, homosexual couples will be given neither obligations nor benefits due to a constant coercion caused by a Catholic majority.

IV. The catholic religion enhances and teaches family values, however, the Costa Rican government must establish a secular state instead of a catholic one owing to the church’s proclaimedinfluence in government and education in order to legalize same-sex civil unions.

Legalizing Gay Marriage: A Step Forward Reaching Development

Homosexualism was a normal sexual practice in ancient societies such as Roman and Greek. At that time, there were other cultures in which homosexuals were pointed out as sick and even evil possessed. The World Health Organization (WHO) (1990) declared that“homosexuality is not a mental illness” (n.p) and that the society is the one affected by an ailment called homophobia. That statement was later supported by the United Nations (UN) establishing May 17th as the International Day Against Homophobia (IDAHO). As a country member of the UN, Costa Rica should legalize gay marriage in order to restore people’s human rights and guarantee the constitutional issuesthat marriage implies even though the Costa Rican catholic state bans it.
Costa Rica must respect the Universal Declaration of the Human Rights (UNDHR) by legalizing gay civil unions with the aim of guarantee to its citizens the right to be recognized as an individual and to be treated equally. Along with the fact that the declaration must be implemented by each UN’s country member in order toavoid discrimination and promote tolerance to minority groups, the Article 1 of the UNDHR (1952) states that “all human beings are born equal in dignity and rights” (n.p). It indicates that every person recognized as Costa Rican must obtain equality by acquiring the same rights given to any other citizen by the country’s laws and the UNDHR just as black people, indigenous populations and womenwere provided with. Meaning anyone must achieve the freedom of sexuality in spite of other people’s opinion, political benefit or religious beliefs, the Article 2 of the same bill establishes that every human being must be given “all the rights and freedoms set forth in this declaration without distinction of any kind, such as race, color, sex, language, religion or other opinion” (n.p).
