ABSTRACT

The research of Incoterms was made based on the International Chamber of Commerce’s rules in order to mention why they were made for and how it is related to the obligations and responsibilities from each part of a buy-sale contract.
First, it’s presented the conceptual part starting by the definition and the importance of the Incoterms in the international commerce according towhat the CCI says. It’s followed by the concepts of the eleven current Incoterms, where there is a specific definition of what the parts have to do or not, so they can coordinate what they have agreed voluntarily in the contract avoiding misunderstandings, complaining and disputes in the future which also creates a delay in the trade flow.
As everyone knows, Incoterms changed until its lastversion by the year 2010, where the CCI tried to simplify the rules and to reduce the insecurity during the international buy sells. The business practices differed from one country to another, a reason why when they are used the parts literally express what the sellers and the buyers assume.
Finally, we point out a sort of recommendations in order to use the best Incoterms according to some benefitsand also the rules that are contrasted with the common mistakes that are made or considered by some exporters which can mean an impact in the final price. Thus, we finish with a case where we can use the previous knowledge about the definition and use of the Incoterms 2010.



INTRODUCCIÓN

La existencia del comercio internacional se remonta hasta antes de la edad media, evidentemente, debido alescaso desarrollo que tuvo en sus inicios, no siempre estuvo regulado por términos de entendimiento global que facilitaran los intercambios comerciales internacionales.
Fue a comienzos de los años 20’s que un grupo de empresarios en Francia consideró hacer algo para la recuperación económica mundial, necesaria después de la gran conmoción de la 1ra Guerra mundial. Debido a esto, tuvieron lainiciativa de crear la Cámara de Comercio Internacional (CCI) así como un sistema mundial de normas para regular el comercio, la inversión, las finanzas o las relaciones comerciales.
Fue la Cámara de Comercio Internacional, en conjunto con expertos y profesionales en comercio internacional quienes crearon, desarrollaron, y hasta ahora actualizan los INCOTERMS.
