“Kits” do not always meet the Customs criteria for Sets

• All items included must contribute to performing a single function

•Everything in the set must generally be used together – no extra parts that are not expected to be used.

• Items in a set must be packed together in the same retail packaging – e.g. the packaging thatthe ultimate purchaser will receive.

• Just because things are packed together does not make them a set.

US Country of Origin Marking: (19 C.F.R 134.11)

– Every article of foreign originimported into the U.S. shall be marked the country of origin of the article.

Articles of a class or kind listed below are excepted from the requirements of country of origin markingin accordance with the provisions of section 304(a)(3)(J), Tariff Act of 1930, as amended (19 U.S.C. 1304(a)(3)(J)). However, in the case of any article described in this list which is imported in acontainer, the outermost container in which the article ordinarily reaches the ultimate purchaser is required to be marked to indicate the origin of its contents in accordance with the requirements ofsubpart C of this part.
