MOBIPOCKET SOFTWARE END USER LICENSE AGREEMENT
PLEASE READ THIS AGREEMENT AND THE MOBIPOCKET PRIVACY POLICY (LOCATED AT http://www.mobipocket.com/en/MyMobi/Cnil.asp) (COLLECTIVELY, THE "AGREEMENT") BEFORE DOWNLOADING OR USING MOBIPOCKET CREATOR, MOBIPOCKET READER OR ANY OTHER MOBIPOCKET SOFTWARE, AND ALL UPDATES, MODIFICATIONS AND ENHANCEMENTS THERETO (COLLECTIVELY, THE “SOFTWARE”). IF YOUDOWNLOAD OR USE THE SOFTWARE, YOU WILL BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, DO NOT DOWNLOAD OR USE THE SOFTWARE.

PLEASE NOTE THAT MOBIPOCKET.COM, S.A., A FRENCH STOCK CORPORATION (SOCIÉTÉ ANONYME) (“MOBIPOCKET”), IS A SUBSIDIARY OF AMAZON.COM, INC. (“AMAZON.COM”) AND AN AFFILIATE OF AMAZON.COM INT’L SALES, INC. (“AMAZON.COM INT’L”), WHICHOPERATES THE www.amazon.fr[->0] WEB SITE. IF YOU HAVE AN AMAZON.COM OR AMAZON.FR ACCOUNT AND COOKIE, MOBIPOCKET IS ABLE TO CORRELATE INFORMATION IT COLLECTS (FOR EXAMPLE, INFORMATION YOU PROVIDE IF YOU DOWNLOAD OR INSTALL THE SOFTWARE) WITH PERSONALLY IDENTIFIABLE INFORMATION THAT AMAZON.COM AND AMAZON.COM INT’L HAVE, AND AMAZON.COM AND AMAZON.COM INT’L HAVE ACCESS TO INFORMATION COLLECTED BYMOBIPOCKET. AMONG OTHER THINGS, MOBIPOCKET, AMAZON.COM AND AMAZON.FR USE THIS INFORMATION TO CUSTOMIZE, PERSONALIZE, AND OTHERWISE IMPROVE THE SERVICES THEY PROVIDE TO YOU.
LICENSE
Subject to your compliance with all of the terms and conditions of this Agreement, Mobipocket grants to you a non-commercial, non-exclusive, non-assignable, non-sublicensable and otherwise non-transferable license to download,install and use the Software on your desktop or laptop computer, PDA, smartphone, or other appropriate device for your personal use. All rights not expressly granted to you by the foregoing sentence are reserved by Mobipocket. Without limiting the generality of the foregoing, you may not copy, modify, distribute or reverse engineer, decompile or disassemble the Software, except that you may makeone copy of the Software for back-up purposes. This license expressly excludes, without limitation, any resale, modification, or commercial use of the Software or any portion thereof and making any derivative works based upon or distributing or copying the Software, except as expressly permitted hereunder. Any unauthorized use terminates the permission or license granted by Mobipocket in thisparagraph.
ILLEGAL, UNAUTHORIZED, OR FRAUDULENT CONTENT OR ACTIVITIES
The Software may be used only for lawful purposes and in a lawful manner, and you agree to comply with all applicable laws and regulations. Mobipocket may investigate any reported violation of its policies and take any action it deems appropriate, including terminating your license to use the Software without notice. Mobipocket mayreport any activity it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other third parties. To cooperate with governmental requests, to protect Mobipocket's systems and users, to ensure the integrity and operation of Mobipocket's business and systems, or in response to subpoenas, court orders, or legal requirements, Mobipocket may access anddisclose any information it considers necessary or appropriate, including user personal information.
COPYRIGHT
The Software is the exclusive property of Mobipocket and protected by U.S. and international copyright laws. All content included on the Software, such as text, graphics, logos, button icons, and images, is the property of Mobipocket or its content suppliers and licensors, and protected byUnited States and international copyright laws. The compilation of all content on the Software is the exclusive property of Mobipocket and protected by U.S. and international copyright laws.
TRADEMARKS
