RESUMEN

La protección especial a la vivienda destinada a la familia compone uno de los
presupuestos ineludibles para dar garantía eficaz al desarrollo armónico e integral
de los niños, toda vez que el ejercicio pleno de los derechos fundamentales de los
menores no pueden materializarse si carecen de habitación digna o si corren elriesgo de perderla.
Nuestra Constitución estableció a favor de la familia y especialmente de los niños,
un patrimonio mínimo que goce de protección frente a cobros judiciales coactivos
y del cual no se pueda disponer, inclusive por quienes lo han constituido, para
fines distintos a la habitación de la familia.
Mediante la Ley 70 de 1931, modificada por la Ley 495 de 1999, fue establecido elpatrimonio de familia con el fin de poner a salvo el patrimonio familiar de las
pretensiones económicas de terceros y caracterizado por ser un patrimonio
especial con calidad de no embargable y cuya constitución puede efectuarse por
acto testamentario o por acto entre vivos. Así mismo, ya bajo el amparo de la
Constitución de 1991, la Ley 258 de 1996 ordenó la afectación de vivienda
familiar,con el fin de impedir que el inmueble de habitación de la familia fuera
hipotecado, embargado o, en general, afectado con otro tipo de gravámenes o
limitaciones de dominio.

El patrimonio de familia, se orienta a proteger la casa de habitación para ponerla
a salvo de las pretensiones económicas de terceros, la afectación a vivienda
familiar tiene por finalidad, además de la inembargabilidaddel inmueble, proteger
al cónyuge no propietario y a sus hijos de los actos de disposición del cónyuge
propietario. (Corte Constitucional Sentencia T 950/2004)

SUMMARY

The special housing protection destined to the family is one of the unavoidable
budgets to give an effective guarantee to the harmonic and integral development of
the children, always the full exercise of the fundamentalrights of the young can not
be materialized if they are homeless or are in risk to lose it.
Our Constitution granted to the family and specially to the children a minimum
share capital that enjoy protection to a judicial collect, which can no t be available
even for those who have created this found and use them for others purposes
different to the family housing.

By means of the law 70of 1931, modified for the law 495 of 1999, was established
the family capital share with the idea of put it save from economic aspirations of
third ones, and characterized for being a special found with the condition of free
seizure of property and which constitution can be made for testamentary act or
within living ones. This same way, and under the support of the Constitution of
1991, thelaw 258 of 1996 ordered the affectation of the family housing, with the
idea to impede that the real state of the family housing was mortgaged or generally
affected by other type of burdens or property limitations.
