DERECHO PENAL II

Introducción:
El pensamiento o el deseo de cometer un delito no es sancionable penalmente, solo cuando exteriorizamos ese deseo puede ser relevante, pero generalmente no sonpunibles los actos preparatorios en la doctrina española. Solo tres tipos de actos preparatorios son punibles:
* la conspiración para delinquir.
* la proposición para delinquir.
* la provocación para delinquir.

FASE INTERNA => no es relevante para el derecho penal
FASE EXTERIOR => es relevante para el derecho penal

En la fase exterior podemos apreciar la fase de ejecución.El delito consumado es aquel en el cual se realizan todas las fases de ejecución del tipo penal en cuestión.
Para distinguir si nos encontramos en actos preparatorios o en la fase de realización del delito tenemos tres teorías:
1. Teoría subjetiva: hay que acudir al sujeto para determinar cuál era su “plan” criminal y de acuerdo a esos delitos, podemos determinar si ha realizado un acto...
