RESUMEN

Teniendo en cuenta las sanciones aplicadas a los miembros de laPolicía Nacional -que
cumplen sus labores en la Ciudad de Manizales- por Inasistencia al servicio, tal como lo
determina el Régimen disciplinario para la misma institución, fue así como se hizo
necesario abordar dicha temática toda vez que se está aplicando una norma que dentro
del contexto jurídico es válida, pero que a la luz de la proporcionalidad y razonabilidad
atentan contra los derechos ygarantías constitucionales de los funcionarios que han
sido objeto de reproche por éste tipo de conducta, se trata más de una norma de
eficacia simbólica que de aplicación material o instrumental.
Su sanción se caracteriza por ser drástica no guardando relación equitativa con el
hecho generado, cuando se ha infringido la misma calificada a titulo de dolo; ya que
antes de entrar en vigenciala ley 1015 de 2006, se aplicaba el decreto 1798 de 2000,
que establecía una sanción en menor escala por la misma conducta y misma
culpabilidad, observando con ello que dicha ley desbordó en este tipo de acción la
dosificación mínima de la sanción con gran diferencia de un régimen al otro.
Para el desarrollo del estudio se aplicó una encuesta a 56 policiales que laboran en el
Departamento dePolicía Caldas, donde se abordan aspectos tales como el
conocimiento normativo, la proporcionalidad de la sanción y la falta, la vulneración de
derechos.

ABSTRAC

Taking into account the penalties imposed on members of the National
Police to perform their work in thecity of Manizales, by absence from
service, as determined by the disciplinary regime for the same institution,
was how it was necessary to address this issue whenever a rule is being
applied within the legal framework that is valid, but that in light of the
proportionality and reasonableness violate the constitutional guarantees of
rights and staff who have been the subject of reproach for thistype of
behavior is more than a symbolic performance standard material or
instrumental application.
His punishment is characterized by drastic equitable unrelated to the event,
when it has broken the same qualified by way of fraud, since before the law
enters into force 1015, 2006, applied the decree 1798 of 2000, which
establishing a penalty on a smaller scale for the same conduct and sameguilt, noting that the law thus spilled over into this type of action the
minimum dosage of the sanction by far one regime to another.
To develop the study used a survey of 56 police working in the Police
Department of Caldas, where he discusses issues such as regulatory
knowledge, the proportionality of the penalty and the offense, the violation
of rights.
