The Spaniard Juan Rivera was released today afternearly 20 years in prison for a murder he did not commit, after the Lake County prosecutor, Michael Waller, decided not to seek review of the judgment of the Appellate Court of Illinois.
On 9 December,the Court of Appeals vacated the sentence passed on Rivera claiming it was "unjustified and unsustainable" due to lack of evidence linking him to the rape and murder of Holly Spear, 11, occurred1992.
"After reviewing the court ruling, as well as the strengths and weaknesses of all the evidence, I have decided that I will not ask the Illinois Supreme review the decision of the Court of Appealsoverturned the conviction of Mr. Rivera," said Waller .

The case was resolved with a DNA test contained in the body of the victim in 1992, but was not analyzed until 2004,when it was found quepertenecía another person.
Also, during the time when the crime occurred, Rivera was under electronic surveillance by another unrelated crime and, as such monitoring, the Spanishnever left his house the night the incident occurred.
During the nearly 20 years, Rivera was convicted three times-in 1993, 1998 and 2009 - and each time the life sentence was overturned on appeal.AGAINST
