A partir de 1696, el estado de salud del rey Carlos II se hace cada vez más alarmante. Se abre paso la idea de un reparto de la Monarquía hispánica, siendo tres los sucesivostratados propuestos para la distribución de la monarquía. Estos tratados fueron realizados a espaldas de Carlos II, que no obstante juega con los intereses de lo pretendientes; el reparto que se realiza demuestra lo débil de la Monarquía Hispana.
El primero (1688), fue un acuerdo entre Luis XIV, rey de Francia y Leopoldo I, el Emperador perteneciente a la Casa de Austria. Los pretendientes, enprincipio, eran los segundones de las respectivas casas reales, condición que cumplía el nieto de Luis XIV, Felipe de Anjou, y el archiduque José Francisco Carlos, segundo hijo del emperador Leopoldo I. Existía además un tercer candidato, Fernando José de Baviera, nieto del Emperador.
