MEXICAN JUSTICE SYSTEM

“In Mexico, being innocent isn’t enough to be free”
INTRODUCTION
In Mexico, it is well known that the institutions responsible for enforcing the provision of justice are not very reliable. Ministries, the courts and prisons are some of the main places where directly, or covered in the legal system, there are a large number of human rights violations and impunityprevails.
The following essay aims to show an Advocacy Group in Mexico that fight against the Criminal and Judicial system in Mexico.
It is two young lawyers, Roberto Hernández y Layda Negrete, who undertake the task of filming, first a documentary film, “The Tunnel”, and then a movie “Presumed Guilty” whose main objective is to clarify the perception of the justice system and criminal courts inMexico.

THE TUNNEL
In Mexico, the jail and the courts are connected through a tunnel, the end of the tunnel locate the accused before the Court, behind a fence. This is the origin of the name of the documentary film released in 2006, one of the first recordings in which is allowed to portray the Mexican criminal justice processes, this film portrays the current system of administration of Justicein Mexico with the voices and faces of people who have suffered injustice and negligence of the Mexican authority. The film shows statistics of the Centre of research and teaching economic (CIDE, by its acronym in Spanish) that leave the spectator shocked and give a broader view of the reality that surrounds the Mexican justice system.

In the majority of cases that occur in this film, is denoted that the evidence and the extent of the crime, do not agree equivalently with the established penalty.This topic gives rise to different aspects that are transformed into real problems within the prison system, which are really a big problem.
Consignment quota
In Mexico to each agent of the public prosecutor is required a consignments quota per week. "Our superiors demand us more consignments and we must comply with this requirement" "They want to consignments? We give them consignments." "Thatare well made, that I cannot assure you." "They do not seek to do work quality, but quantity" expresses an agent of the public prosecutor.
Minor offences and unjustified arrests
The use of pre-trial detention in Mexico has been excessive and in many cases is considered unfair, in 2007 there were 92,000 people inside, which amounts to 40% which is in jail without having even a sentence. In additionto this 40%, 14% was declared innocent and 85% has less than five sentences, that most of the times are unjustified.
Statements of the Santa Martha prison inmates:
"I've been 2 months in jail for a teddy bear and the only evidence are photos of the toy"
"I was accused for stealing articles of perfumery in a supermarket (a shampoo, a deodorant and a cream) with value of 200 pesos, sentenced to4 years in prison"
"I’m accuse of stealing 200 pesos and condemn to a sentence of 6 years 11 days"
Corruption
The documentary shows the corruption in the public prosecutor's Office and the recoil of the system of Justice of Mexico, which does not impart justice, but on the contrary, is responsible for blaming innocent and honest people, and leave free the guilty giving bite in exchange foranything.

* -There is corruption in the public prosecutor's Office?
* -Depends on the turn, he jokes. There is corruption in all the Public Ministry, that is inevitable. Those who reach the hereof are people that don't have money, because if they did they go free. The law is for those who have money to pay for a good lawyer to defend them....
