SOVEREIGNTY ARGUMENT
1. The counterpart has alleged violations to their sovereignty, quality to which they are rightfully entitled. It must be pointed out, nonetheless, that such a seriousaccusation has yet to find enough support for it to be accepted.

2. First of all, it is vital to mention that we, as a State, acted as a sovereign nation. Within the principles of the UN, not onlyestablished in the Chart, every State has the right to determine its own political, economic and social system, which was set forth by the General assembly in the Declaration on principles ofinternational law friendly relation and co-operation. In countless occasions, it has been exposed the agonic situation trough which Colombia is passing thanks to the armed conflict leaded mainly by the FARCgroup. Under such circumstances our government has sought to take every reasonable measure to both combat the stated conflict as well as to abide by its international obligations. Measures that havereshaped the socio-political system, as an answer to the reiterative offenses perpetrated by FARC. It is therefore, plausible to accept that the use of herbicides via air spraying constitutes a waythrough which Colombia is exercising its sovereignty, to which is rightfully entitled. For the Court is not unacknowledged the fact that those crops, which are sought to be eradicated, are ways by whichterrorism is financed as well as the FARC group who much suffer has caused to our beloved nation.

3. Not every action unilaterally taken by a State constitutes a breach of internationalobligations, not even if its effects may reach other States sovereign territories. In Argentina v. Uruguay this Court ruled that in spite that the actions taken by Uruguay involved the construction of twopoll mills in the Uruguay River, which links the two nations, Uruguay was rightfully entitled to begin such proceedings as it amounted to an act of a sovereign State.
