ADMINISTRATIVOS DE EFECTOS PARTICULARES
RESUMEN
El análisis de los efectos de la sentencia estimatoria de amparo autónomo contra
acto administrativo de efectos particulares, es de gran importancia, porque cada día el
amparo, debido a lo largo de los procesos existentes en elordenamiento jurídico vigente1,
se presenta como una alternativa de justicia rápida y expedita; ahora bien, cuando se intenta
un amparo autónomo contra la violación o amenaza de violación originada en un acto
administrativo y el juez declara con lugar la acción, ordenando el restablecimiento de la
situación jurídica infringida, se presenta el dilema de que le sucede al acto administrativo
que originóla lesión, debido a que la doctrina y la jurisprudencia le niegan los efectos
anulatorios a la sentencia estimatoria de amparo; en este marco, se emprende la tarea de
encontrar una solución que unifique criterios y ofrecer una solución única al problema. En
este sentido, se realiza está investigación y del análisis efectuado, se concluye que la
sentencia estimatoria de amparo en estudio, sí puedeproducir efectos anulatorios, pero
únicamente, hacia el futuro y que debe ser manifestado así, expresamente por el juez en la
sentencia estimatoria, correspondiente.

ABSTRACT
DECLARATORY JUDGEMENT REGARDING ADMINISTRATIVE ACTS OFINDIVIDUAL EFFECTS
The analysis of the effects of a declaratory judgement based on a suit seeking help
against administrative acts of individual effects ('amparo autónomo', which is comparable
to both the '1983 Section' suit or the habeas corpus in common law systems), constitutes a
matter of of great importance because it represents a considerably faster and expeditious
alternative in terms of timelength, than an ordinary claim routed through the ordinary
procedures applicable according to the current legislation.
Once the decision has awarded to the plaintiff any form of injuction (preliminary,
permanent or both) besides a declaratory judgement against the harm or threat of harm of
constitutional rights based on an administrative individual act, there remain the dilemma of
determining thefurther validity of the said unconstitutional act henceforward, based on the
fact that the most current opinions and jurisprudence are in accord by affirming that such
declaratory judgements in this matters may not produce nullifying against the
administrative act that caused the original claim.
Given these apparent contradictions and dichotomy between the notions of
declaratory judgements, thegeneral opinion of specialized authors in the field and the
current trends in jurisprudence, the task consists of finding a unifying solution to the
problem.
Based on the previous assumptions and the main problem, this investigation and its
analysis purports to conclude that the said declaratory judgements can indeed produce
nullifying effects against the individual administrative act that...

RESUMEN
El análisis de los efectos de la sentencia estimatoria de amparo autónomo contra
acto administrativo de efectos particulares, es de gran importancia, porque cada día el
