END USER LICENSE AGREEMENT

hereinafter referred to as «theCompany » or « the Licensor»,
PARTY OF THE FIRST PART,

And
- You, the End User,
hereinafter referred to as « the User » or « the Licensee»

PARTY OF THE SECOND PART.

PREAMBLE
PLEASE READ THIS SOFTWARE LICENCE AGREEMENT ("LICENSE") BEFORE USING THE SOFTWARE. BY USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU ARE ACCESSING THE SOFTWAREELECTRONICALLY, SIGNIFY YOUR AGREEMENT TO BE BOUND BY THE TERMS OF THIS LICENSE BY CLICKING THE “AGREE/ACCEPT” BUTTON. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, RETURN THE PULPMOTION SOFTWARE TO THE PLACE WHERE YOU OBTAINED IT FOR A REFUND OR, IF THE SOFTWARE WAS ACCESSED ELECTRONICALLY, CLICK “DISAGREE/DECLINE” AND SEND US AN E-MAIL AT SUPPORT@AQUAFADAS.COM.
REMINDER: INSOFAR AS THE PULPMOTIONSOFTWARE MAY BE USED TO INTEGRATE VIDEO OR PICTURES FILES, OR MUSIC, IT IS LICENSED TO YOU ONLY TO DIFFUSE SUCH DATA AS YOU ARE AUTHORIZED OR LEGALLY PERMITTED TO REPRODUCE.
ARTICLE 1 - DEFINITIONS
In this contract, the following terms, when they are written with a capital letter, will have the following meaning:
Contract: indicates the License agreement and any forthcoming upgrades andappendices.
Themes : indicates the ensemble of designs and animations integrated in the PulpMotion software which can contain Your videos or pictures. These Themes and animations are created by Artists and the personnel of Aquafadas, who ceded their rights to the Licensor.
Data : Files including images, music, videos or pictures integrated by the User into a Theme provided by the PulpMotion softwareand for which You have either authorization or reproduction rights.
Compositions : Animations created with the PulpMotion themes and integrating the user’s data.
License : Contract by which Aquafadas authorizes You to use the PulpMotion program under certain conditions defined below.
Software : The data-processing program named PulpMotion which makes it possible to integrate the video andimages files into animated Themes.
Party : indicates collectively the Licensee and the Licensor.

ARTICLE 2 – PURPOSE

The purpose of this Contract is to define the terms and the conditions under which Aquafadas (the Licensor) grants You (the Licensee) a license relating to the PulpMotion software, and documentation, for the use of the PulpMotion software in conformity with the terms of thisagreement.
Aquafadas reserves all rights not expressly granted to You. The rights granted herein are limited to Aquafadas's and its licensors' intellectual property rights in the PulpMotion Software and do not include any other patents or intellectual property rights.


ARTICLE 3 – GRANT OF THE LICENSE
3.1 – Extent
Aquafadas grants You a licence valid worldwide, limited to the exclusive useby the principal User of the original version of the software, which can neither be transferred, nor distributed, nor lent.
Aquafadas reserves the right to correct errors, or bugs that have been brought to the attention of the Aquafadas team by the users. You have no right to access the source code of the Software, to copy it (except in the case of backup copying), to decompile, to reverseengineer, to dismantle, to modify, or to create by-products of the PulpMotion software or any part thereof. Any act of this nature is cause for the cancellation of this Contract.
If the Software is to be used outside the domestic circle (in an association, notably), Aquafadas requires You to inform us, before any use, at the following address, of the uses to which the Software will be put:...
