ARGUMENTACIÓN DEL DERECHO

BREVE RESEÑA DE LA TEORÍA DEL ACTO JURÍDICO Y EL IMPACTO DE LA TEORÍA DE LA INEXISTENCIA Y NULIDADES SEGÚN BONNECASE Doctora Raquel Sandra Contreras López* RESUMEN: La estructura del acto jurídico se ha delineado en el marco de las doctrinas francesa y alemana, en cada una de ellas, el acto jurídico tiene sus propios límites y cauces, lo que hace a estas Teoríasirreductibles en su aplicación práctica; y si bien, el acto jurídico de la Teoría francesa, y el negocio jurídico de la Teoría alemana comparten la licitud en su objeto, no tienen los mismos elementos estructurales, tomando en cuenta que en el Sistema jurídico mexicano, el legislador del Código civil de 1928 en la sistematización de la estructura acto jurídico que llevó a cabo en el mismo, se inspiróen la Tesis de la inexistencia y nulidades Julián Bonnecase, lo que no fue posible, por razones de construcción en el tiempo, respecto al propio acto jurídico del Derecho civil francés y al negocio jurídico alemán, lo que indudablemente, impacta en su propia doctrina de las nulidades e ineficacias del sistema civil europeo, a diferencia de cómo ocurre en el sistema civil mexicano. BRIEF SUMMARY OF THE JURIDICAL ACT THEORY AND THE IMPACT OF THE INEXISTENCE AND NULLITY THEORY, ACCORDING TO BONNECASE Raquel Sandra Contreras López, PhD ABSTRACT: The structure of the juridical act has been outlined in the framework of the French and German doctrines; in each one of them, the juridical act has its ownlimitations and legal actions, which make these Theories unyielding in their practical application; and so, if the juridical act of the French and German theory share legality in their objective, they do not have the same structural elements, taking into account that in the Mexican Juridical System, the legislator of the 1928 Civil Code in the systematization of the structure juridical act that wascarried out, was inspired in Julián Bonnecase’s Thesis of Inexistence and Nullities, which was not possible for reasons of time structures, in relation with the juridical act in the French Civil Law and the German’s legal transactions which, undoubtedly, creates an impact in his own doctrine of nullities and ineffectiveness in the European civil system, unlike in the Mexican Civil System.Keywords: Juridical act, juridical fact, legal transactions, theory of nullities.
