The right to privacy has evolved to protect the freedom of individuals to perform certain actions and undergo certain experiences. This personal autonomy has grown to become a fundamental rightprotected by the due process of the fourteenth constitutional amendment clause. However, this right is limited and generally protects only the privacy of the family, marriage, motherhood, procreation andchild-rearing.

The fundamental right to privacy has acquired new dimensions in the society. Many authors argue that it is the same right and others have given new designations under thecharacteristics that make it differ from what it traditionally understood as intimacy in the analog age.
The technology has been capable of generating such dramatic changes in labor, economic life and ineveryday life today, the need to resize the protection of certain rights of citizens, so that they are not undermined to vulnerability in which are found as a result of the technological revolution. Theright to privacy as a fundamental pillar of protection to the individuality of the person have been violated by the indiscriminate transfer of data which goes beyond the borders and sovereignty ofeach region, with surprising speed.

The Internet introduced a form of invisible processing of data 2 that has been accentuated through e-commerce. Every day thousands of people provide theirpersonal data of express or tacit way to public and private companies over the Internet.
