¿ESTÁ JUSTIFICADO ELIMINAR LAS CAUSALES DE DIVORCIO PREVISTAS EN LOS CÓDIGOS CIVILES DEL DISTRITO FEDERAL Y COAHUILA CONFORME A LA CONSTITUCIÓN?

RESUMEN: El presentetrabajo describe el cambio que ha habido en las legislaciones del Distrito Federal y el Estado de Coahuila respecto a la eliminación de las causales de divorcio y del entendimiento del matrimonio, asícomo las últimas sentencias de la Suprema Corte de Justicia de la Nación que declararon la invalidez de dichas causales por ser contrarias al derecho al libre desarrollo de la personalidad, deconformidad con las reformas constitucionales de junio de 2011 en materia de derechos humanos.
La investigación concluye con la exposición de algunos argumentos a favor de este cambio institucional enCoahuila y el Distrito Federal, desde una postura constitucional, liberal e igualitaria, como la propuesta por juristas como Carlos S. Nino y Rodolfo Vázquez.
ABSTRACT: This paper describes the change thathas occurred in the laws of the Federal District and the State of Coahuila, with respect to the elimination of the causes of divorce and the understanding of marriage, as well as the latest judgmentsof the Supreme Court of Justice of the nation, who declared the invalidity of such grounds for being contrary to the right to the free development of the personality, in accordance with theconstitutional reforms stablished in June, 2011 in the field of human rights.
