LA PRUEBA PERICIAL PSICOLÓGICA EN ASUNTOS DE
VIOLENCIA DE GÉNERO1
(EXPERT TESTIMONY IN CASES OF DOMESTIC VIOLENCE)

RESUMEN:
Considerando la importancia de la prueba de la violencia psicológica en situaciones de malos tratos en
el ámbito familiar, es necesario exponer y explicar el proceso pericial mediante el cual se puede llegar a
concluir este extremo en un dictamen efectivo. Se exponen distintas concepciones de violencia
psicológica, el proceso evaluativo mediante elcual se pretende demostrar la existencia de este tipo de
violencia y distintas teorías que lo sustentan, las consecuencias negativas y secuelas psicológicas y
sociales en las víctimas y su entorno, el mejor método para llegar a un nexo causal de tales secuelas, un
breve apunte sobre la credibilidad del testimonio como estrategia para reforzar las conclusiones del
dictamen pericial y unanálisis de la intervención del psicólogo forense, de oficio o de parte, en la
Administración de Justicia. Se pretende con ello conseguir la mejor actuación multidisciplinar jurídicopsicológica, sabiendo del peso de la prueba pericial en estos asuntos.

ABSTRACT:
Taking into account the importanceof the psychological injury evidence in situations of physical
violence in a family environment, it is necessary to show and to explain the expert testimony which helps
to bring this point to an effective opinion. Several meanings of psychological violence are stated, the
evaluative process used to show the existence of that kind of violence and various theories that defend the
process, thevictim’s and its environment negative consequences and psychological / social damages, the
best method to reach to a causal link of such damages, a note of the evidence credibility as a strategy to
re-enforce the conclusions of the expert testimony and a study of the intervention the psychologist
forensic, in the justice system. The objective is tried to achieve the best legal andpsychological crossdisciplinary action, taking into account the importance of the expert testimony in these matters.
