Why do we need law in international affairs? Is law an effective instrument for restraining the action of the states? “The United States have not intervened with military forces either in North Koreaor Iran, because both of them possess nuclear weapons and in consequences can threat the stability of the Nation if it takes action against those regimes”, is what argued one of the three witnessesduring a hearing of the Foreign Affairs Committee at the House of Representatives. Arguments with such nature put in perspectives: The International Law is what really restraints the actions of thestates or moreover the capabilities that have a determined state to threat the stability of another state. It opens a debate that includes; the international law is an effective instrument in restrainingthe actions of the states, or it follows the realist view that it rather depends in the resources that has an state to confront other states, that in consequence enforces the fulfillment of theinternational law. The objective of the International law and is to promote a peaceful interaction among states within the anarchic situations of the international field, either in peace situations or inabsence of peace.

In the case of the international law, there non-existence of such code of International Law, there is no existence of a parliament which makes really difficult to describesomething as legislation. International Law is rooted in different international organizations whose objective is to bring peace and to provide a better lifestyle for those in needs specially mediating in theuneven distribution of the natural resources. Depending in the specialization of the courts or tribunals that are mainly established by different areas of specialization and in which its jurisdictiondepends upon the consent of the states involved and it mainly lacks of the compulsory jurisdiction that characterize the national courts1.
