EL DERECHO CONSTITUCIONAL Y LA
PROTECCION A LA PROPIEDAD INTELECTUAL

RESUMEN
La estructura de la protección constitucional de la propiedad intelectual tiene como base el artículo 17 de
nuestra Carta Magna, cuando dice: “…Todo autor o inventores propietario exclusivo de su obra, invento o
descubrimiento, por el término que le acuerde la ley…”
Por otro lado, y no menos importante, el artículo 14 dispone: “Todos los habitantes de la Nación gozan de los
siguientes derechos conforme a las leyes que reglamenten su ejercicio, a saber: de trabajar y ejercer toda industria
lícita…de usar y disponer de su propiedad…”
Como se aprecia lapropiedad sobre bienes intangibles tiene su reconocimiento en nuestra norma
fundamental, no solo en la parte citada del artículo 17 sino que se infiere lógicamente de lo transcripto del artículo
14, el que tienen intima relación con el 17, que comienza diciendo “La propiedad es inviolable y ningún habitante de
la Nación puede ser privado de ella…”
Sobre esta normativa citada y sobre los pactosinternacionales en la materia ratificados por Argentina, que en virtud
de lo dispuesto por el artículo 75 inciso 22, tienen jerarquía superior a las leyes, es que toma sentido, y asimismo se
fundamentan las leyes nacionales relativas al reconocimiento y protección de los bienes intangibles –intelectuales-.

PROPERTY’S PROTECTION

ABSTRACT
The structure of the Intellectual Property´s constitutional protection has asbase the article 17 of our
Constitution, when says: "…Every author or inventor is exclusive owner of its work, invention or discovery, by the
term that the law agree him…"
On the other hand, and not less important, the article 14 arranges: "All the inhabitants of the Nation enjoy
the following rights according to the laws that regulate their exercise, to know: to work and to exercise lawfulevery
industry…to use and to have its property…"
As everyone might see, the property on intangible goods has its recognition in our Constitution not only in the part
cited of the article 17, but also is inferred logically from article 14, which has intimate relation with the 17 that begins
saying "The property is inviolable and no inhabitant of the Nation can be private of her…"
On thisregulation cited and on the international treaties in the matter ratified by Argentina, which by the
article 75 clause 22 are in a superior level over the laws, is that makes sense and also support the national laws related
to the recognition and protection of the intangible goods –intellectual-.
