Resumen:
La
única
aportación
tradicionalmente
atribuida
al
“constitucionalismo” inglés se ha entendido que era la de la Revolución
Gloriosa de 1688, muy alejada de la “soberaníapopular” defendida luego por
las democracias modernas. Sin embargo, el “pueblo” ya llegó a surgir como
principal sujeto del poder en la Revolución Inglesa de 1642, con el
acompañamiento de la teoría contractual y la preexistencia de unos derechos
pertenecientes a todo “hombre libre”. Los levellers (“niveladores”), reunidos
bajo la bandera de los Agreements of the People (“Acuerdos del Pueblo”),reunieron una coalición social que sostendría tal modelo, tras una lucha
parlamentaria contra el Rey de la que habían extraído como principal
conclusión la de que no sólo el monarca, sino que también el Parlamento podía
utilizar su poder arbitrariamente. Con los Agreements se buscaba proteger
mediante un documento escrito que fuera norma suprema (“paramount law”),
los derechos y libertadesfundamentales de los ingleses, así como el
entramado institucional y democrático en el que podrían hacerse valer.
Abstract: Traditionally, research has indicated that the Glorious Revolution of
1688 was the only contribution to English constitutionalism, which differed from
“popular sovereignty” modern democracies stood for later on. However, “the
people” had already appeared as the main subject of power inthe English
Revolution that took place between 1642-1649, and the contractual theory as
well as the idea of pre-existent rights attached to every English “freeman” were
also manifest. A social coalition led by the Levellers and their defense of the
Agreements of the People would support such political model after a
parliamentarian struggle against the King where they became aware of the fact
thatnot just the King but the Parliament itself could use the power arbitrarily.

With those Agreements protection was pursued by means of a written
document, a “paramount law”, where the democratic and institutional framework
and the rights and fundamental liberties for the English embedded in it, would
be attained.

I. INTRODUCCIÓN: LA PRIMERA RUPTURA EUROPEA CON EL ANTIGUO
RÉGIMEN
1. Gran parte del interés académico se ha centrado en la investigación
sobre los orígenes de la democracia constitucional. Inevitablemente,
damos en nuestras pesquisas con las revoluciones francesa de 1789 y
americana de1776, e incluso, para ciertos autores, hallaríamos un buen
yacimiento explicativo en la Gloriosa de 1688. Sin embargo, esta última,
y pese a que inauguró el esquema político del Reino Unido que llega
hasta hoy día, no pasó de ejercer una influencia escasa y carecía de
algún tipo de Carta Constitucional al modo contemporáneo. A lo que dio
origen fue a la sedimentación progresiva de varios elementos...
