COMMISSION DECISION of 18/01/2011 establishing the 2011 Work Programme for implementation of the 'Intelligent Energy - Europe II' programme

THE EUROPEANCOMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Decision No 1639/2006/EC of the European Parliament and of the Council of 24 October 2006 establishing a Competitiveness and Innovation Framework Programme (2007 to 2013) 1 , and in particular Articles 37 to 45 thereof, Having regard to Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on theFinancial Regulation applicable to the general budget of the European Communities 2 , and in particular Articles 75(2) and 110(1) thereof, Having regard to Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the EuropeanCommunities 3 , and in particular Articles 90 and 166 thereof, Having regard to Commission Decision 2007/372/EC of 31 May 2007 amending Decision 2004/20/EC in order to transform the Intelligent Energy Executive Agency into the Executive Agency for Competitiveness and Innovation (hereinafter referred to as “the EACI”) 4 , and to Decision C (2007) 3198 of 9 July 2007 entrusting the EACI with certainmanagement tasks linked to implementation of the Entrepreneurship and Innovation Programme under the Competitiveness and Innovation Framework Programme, the Intelligent Energy – Europe Programme under the Competitiveness and Innovation Framework Programme and the Marco Polo Programme in the field of transport, Whereas: (1) The annual work programme is to be established in accordance with Article 45of Decision No 1639/2006/EC establishing a Competitiveness and Innovation Framework Programme (2007 to 2013) in line with the objectives set out in Articles 37 and 38 of the same Decision.

In accordance with Article 75 of the Financial Regulation and Article 90(1) of the Implementing Rules, the commitment of expenditure from the European Union budget shall be preceded by a financing decision setting out the essential elements of the action involving expenditure andadopted by the institution or the authorities to which powers have been delegated by the institution. The 2011 work programme being a sufficiently detailed framework in the meaning of Article 90(2) and (3) of the Implementing Rules, the present decision constitutes a financing decision for the expenditure provided in the work programme for grants and procurement. The IEE Management Committee set upunder Article 46(1)(c) of Decision No 1639/2006/EC establishing a Competitiveness and Innovation Framework Programme (2007 to 2013) has been consulted on the 2011 Work Programme for implementation of the “Intelligent Energy – Europe II” Programme and has endorsed it. An analysis was carried out under the auspices of Intelligent Energy Europe Programme I (2003-2006) which led to the conclusion that,for grants under Intelligent Energy — Europe II Programme, 60 % of eligible staff costs would be an acceptable level of overheads. This flat rate would notably simplify the management of contracts, both for beneficiaries and for the Commission. It will be reviewed in the framework of ex-post financial controls and revised as appropriate.
