REIVINDICANDO UNA IMPORTACIÓN: “EL IMPEDIMENTO DEL EJERCICIO DEL DERECHO DE DESISTIMIENTO EN EL MARCO DE UN CONTRATO DE MANDATO CON REPRESENTACIÓN”

Resumen:
La norma materia de análisis en esta oportunidad se encuentra en el capitulo de la representación en el libro de Acto Jurídico, sin embargo, esta norma se encuentra contenida en dicho lugar como producto de unamala importación.
La naturaleza jurídica del presente tema lo podemos encontrar en el artículo 153 del Código Civil y en la legislación comparado en los artículos 1723 y 1725 del Código Civil Italiano, siendo esta una discusión doctrinaria. Que nace por la mala importación de dichas normas italianas a nuestro cuerpo normativo civil sin tomar en cuenta las respuestas y estudios de ladoctrina tanto alemana como italiana.
El artículo 153 del Código Civil, regula objetivamente el poder irrevocable para cuatro supuestos, será irrevocable el poder cuando este es otorgado para un acto especial, para un tiempo limitado, en comun interes del representado y el representante o en común interes del representado y un tercero, el plazo maximo del poder irrevocable sera el de un año.Sin embargo ¿ es realmente irrevocable el poder irrevocable?, la respuesta es negativa, no existe subjetivamente el poder irrevocable, el poder siempre será revocable, pues lo contenido en el Art. 153 del Código Civil no regula sustancialmente el poder sino que debería estar regulado en el capitulo sobre el mandato con el nombre de: “Impedimento del ejercicio del derecho de Desistimiento” en elmarco de un contrato de mandato con Representación, sin olvidar regular la facultad de desistimiento cuando exista justa causa .
Por lo que se propone derogar la norma materia de análisis y normar dicha figura jurídica de la forma y en el lugar antes mencionado, lo cual sería lo jurídicamente correcto.

Abstract
The norm matter of analysis in this opportunity is in the chapter of the representation in the book of Legal transaction, nevertheless, this norm is contained in this place like product of a bad import.
The legal nature of the present we can find it subject in article 153 of the Civil Code and in the legislation compared in articles1723 and 1725 of the Italian Civil Code, being this doctrinary discussion. That it is born by the bad import of these Italian norms to our civil normative body without taking into account the answers and studies from the German doctrine as as much Italian.
Article 153 of the Civil Code, objectively regulates the irrevocable power for four assumptions, will be irrevocable the power when this itis granted for a special act, for a limited time, common representative and interest represented or common interest of represented and a third party, the term maximum of the irrevocable power sera the one of a year. Nevertheless is really irrevocable the irrevocable power? , the answer is negative, does not exist the irrevocable power subjectively, the power always will be revocable, because thecontent in Art. 153 of the Civil Code does not regulate the power substantially but it would have to be regulated in the chapter on the mandate with the name of: “Impediment of the exercise of the right of Dropping of the claim” within the framework of a mandate contract with Representation, without forgetting to regulate the dropping of the claim faculty when right cause exists.
