2008 Interim Rental Contract


THIS INTERIM RENTAL AGREEMENT IS ENTERED INTO AND BETWEEN ------------------- (hereinafter, the "Owner"); AND ------------------- (hereinafter, the “Agent”) REPRESENTED BY ---------------------, (BOTH “Agent” AND “Owner” ARE JOINTLY REFERRED TO AS “THE PARTIES), ACCORDING TO THE FOLLOWING RECITAL AND CLAUSES:



RECITAL

1. The “Owner” declares:

a.That is the legally owner of the Private Villa/Condominium known as ___________ (hereinafter, the Property), that is located at ________________, according with the Property title number 34,502, before Lic.----------------- Notary Public of ----------------------, dated ------
b. That it is his/her intention to hire the professional services of a specialize company, that will be inexclusively or --- non exclusively in charge of rent/lease the Property.
c. That the building is free of all burdens and current in the payment of its taxes, such as property tax, etc.

a. b. That who appear in the celebration of this contract has sufficient authority to execute thisAgreement on behalf of the AGENT as evidence in the document mentioned above.
c. That according with the object of the company, it is specialize in rendering professional services for renting/leasing properties

a) THEREFORE, in consideration of their mutual covenants and agreements,the Parties agree to enter into this Agreement, according to the terms and conditions, contained in the following.


ARTICLES AND OR CLAUSES

1. Purpose.

Owner agrees to hire the professional services of the Agent, that will be in exclusively or --- non exclusively in charge of rent/lease the Property, for a period not less than 12 month, and continuing on a month-to-month basis thereafter,it is important to mention that this agreement will be subject to a 30 days written notice of in case either party wants to terminate it.


1. Leasing, Rent and Security Deposits
a. AGENT agrees to advertise the availability of the property for rent or lease.
b. AGENT will work diligently to procure tenants at the rental rates approved by
OWNER.
c. AGENT is authorized tonegotiate rentals on behalf of OWNER for a
minimum of three (3) nights and not to exceed ____one month or ____other
(_______________________).
d. AGENT will use diligence in the screening and selection of tenants, subject to
guidelines set forth in writing by OWNER.
e. AGENT will collect rent, 10 % IVA and 3% Mexican lodging tax and deposit
suchmonies into an account with a qualified banking institution.


2. Records and Reports
a. AGENT shall maintain accurate records of all monies received and disbursed
in connection with its property rental services, and said records shall be open
for questioning by OWNER during regular business hours upon 24 hours
notice.
b. AGENT agrees to submit rental revenue and amonthly statement to OWNER
by the 15th of the month following each tenant’s arrival. If OWNER desires,
AGENT will electronically transfer these funds and email a statement to
OWNER, subject to a $-- fee.

3. Agent Commission
OWNER agrees to allow AGENT to pre-deduct a commission for each
reservation in the amount of 30% of the advertised rate (excluding tax) as...
