EN EL CASTIGO POLICIAL

RESUMEN
El artículo examina los alcances de lapotestad de aplicar castigos por parte de la policía, con particular referencia al medio venezolano, tanto en relación con su participación dentro del sistema de justicia penal, como en su desempeño autónomo, como agencia de control social dotada de poder coactivo inmediato en estrecha relación con los ciudadanos con ocasión de la identificación y disuasión de infracciones. Se plantea la hipótesis deldesarrollo de una potestad extralegal de castigo policial sustitutivo y/o complementario vinculada a la desconfianza en el desempeño de otras instancias dentro del sistema penal, tanto en situaciones de dificultad para recabar suficientes elementos probatorios como en casos en los que se anticipa que las restantes instancias del sistema prestarán escasa atención a hechos considerados graves. Lahipótesis es analizada en el contexto de comentarios obtenidos a través de 14 entrevistas con funcionarios policiales de dos cuerpos del área metropolitana de Caracas, y encuentra respaldo mediante el análisis de frecuencia y contenido de las entrevistas. Emerge, además, un patrón de castigo policial sustitutivo en casos de victimización que afecta la vida e integridad de funcionarios policiales,hasta el momento insuficientemente identificado y descrito. Se sugiere profundizar la investigación para determinar con mayor precisión los códigos, supuestos y motivaciones para la sustentación de castigos policiales al margen de la legalidad formal.

REPERCUSSIONS IN THE JUDICIAL SYSTEM OF POLICE PUNISHMENTABSTRACT
This article deals with the power of punishment on the part of police, particularly related to the Venezuelan case, both in relation with its role as an agency of the criminal justice system and in its autonomous performance as a social control agency endowed with diirect coercive power and in close contact with citizens in relation to identification and disuasive action. The hypothesisexists that the development of extralegal substitute or complementary police punishment together with the lack of trust in other agencies within the penal system, both in situations where probatory evidence is lacking and where other judicial agencies place little attention to what should be considrerd grave considerations is occurring. The hypothesis is analyzed in relation to comments obtained in 14interviews with police officials from two police corps in Caracas, and is backed up by an analysis of frecuency and content in the interviews. There appears to be a pattern of substitute police punishment in casas of victimization which affects the life and integrity of police officers, which is up untiil this moment insufficiently described and identified. A deepening of the research is suggestedin order to determine with more precision
the codes, suppositions and motivations for the substitution of police punishment beyond what is formally legal.

1. INTRODUCCIÓN: POLICÍA, CONTROL SOCIAL Y CASTIGO
La policía puede ser entendida como una instancia de control social formal, como una institución de carácterestatal, dotada de poder coactivo inmediato, encargada primordialmente de individualizar, detectar al autor, restringir y/o prevenir conductas jurídicamente inaceptables (Gabaldón, Birkbeck y Bettiol, 1990: 22).
