Sources of International Law
Common law is the laws that are built on tradition and precedent, not every possible situation is codified, they rely on their courts to interpret and apply to moregeneral statutes. (United States, England)
Code law system do not rely on court decisions but rely on statutes or codes that are intended to cover all types of circumstances. (France, Germany, Spain etc)A Final system law is based on religious tenets and governs all aspects of life, from appropriate dress in public to remedies for contract breaches.
The American Bar Association recommends thatbusinesspeople and their lawyers examine seven cultural factors and do background work in these cultural areas, and is referred as LESCANT:
Language: in Quebec, Canadian government regulations outlinethe use of French in conducting business. But the Dominant language for contracts is English.
Environment and Technology: Doing businesses in a country in which technology is less developed andcommunications is slower for make contract negotiations.
Social Organization: Should know the social order in the country: May women negotiate deals? Is it appropriate to discuss business during a meal?Contexting: Low-context cultures are those that rely on the written word as the controlling factor in their relationship. (North American countries, Germany etc). High-context cultures know how andin what setting an agreement is reached are as important as the words in the document itself. (Latin American Countries, Asian Countries)
Authority: Who has negotiating authority is important in abusiness meeting. Lawyers are not considered part of the negotiating team in Japan, but are considered critical in the United States.
Nonverbal Behavior: Silence during negotiation in the United Statescreates a compulsion for business people to fill the awkward silence or interpret the silences as a rejection, but in Asian cultures silence is simply as method of contemplating and considering and...
