LAS FAJAS LUMBARES COMO IMPLEMENTOS DE SEGURIDAD

RESUMEN
La presente investigación se orientó en determinar desde el punto de vista
científico-práctico, si las fajas lumbares son un implemento de seguridad
obligatorio en nuestro ordenamiento jurídico, a fine deestablecer con criterios
objetivos, si resulta o no procedente la responsabilidad subjetiva del patrono que
haya inobservado la obligación legal de proveerlas. El diseño de investigación
implementado es documental/explicativo. Las unidades de análisis para el
desarrollo de los tópico abordados, fueron las normas que rigen la materia de
seguridad, higiene y ambiente en nuestra legislación(Constitución, LOPCYMAT,
el Reglamento de las Condiciones de Higiene y Seguridad en el Trabajo, Norma
COVENIN 2237-89) y los estudios y criterios desarrollados por las instituciones
más reconocidas en materia de salud ocupacional a nivel mundial, en relación a
la eficacia de las fajas lumbares. Una vez estudiados y adminiculados los
documentos y criterios que conforman la investigación en relación al usode las
fajas compresivas, se concluye que si bien el uso de los cinturones de columna
está prescrito por la norma de forma expresa, estos no son calificadas como un
implemento de seguridad, por cuanto además de que su efectividad no ha sido
comprobada, su uso prolongado causa efectos negativos en quienes las portan,
motivo por el cual, desde el punto de vista jurídico, resulta improcedente laresponsabilidad subjetiva en los casos en que el patrono no provea a sus
trabajadores de dichos equipos, aun y cuando esta conducta omisiva contravenga
lo expresamente establecido en la norma.

ABSTRAC
The present investigation was orientated in determining from the scientific practical point of view, if the lumbar strips arean obligatory implement of safety in
our juridical classification, to the ends (purposes) of establishing with objective
criteria, if it he proves or not proceeding the subjective responsibility of the
employer who has unobserved the legal obligation to provide them. The design of
investigation implemented is documentary / explanatory. The units of analysis for
the development of topicapproached, were the procedure that govern the safety
matter, hygiene and environment in our legislation (Constitution, LOPCYMAT, the
