In this case the Supreme Court had to resolve the appeal from the United States court in the cases from the states ok Kansas, South Carolina, Virginia, and Delaware. It happened in the yearof 1954, where the Negro children were segregated under the permission of state laws and the doctrine “separate but equal “made in the Plessey vs Ferguson, 163 us 537 cases.
The Negro children weredenied the admission to schools in their community, all of this being done by a racial segregation, which wasn’t attending to the Equal Protection clause of the fourteenth amendment.

Forthis case are several precedents such as Cumming v . County Board of Education, 175 U.S. 528., Gong Lum v. Rice, 275 U.S. 78, Missouri ex rel. Gaines v. Canada, 305 U.S. 337; Sipuel v. Oklahoma, 332U.S. 631; Sweatt v. Painter, 339 U.S. 629; McLaurin v. Oklahoma State Regents, 339 U.S. 637, the most important one is the one that placed the doctrine of “equal but separate” doctrine, Plessey v.Ferguson in which the facts of it is that a colored person sat on the seat of a railway where only white passengers were seated, so he was asked to move to another seat, as he denied to do it he gotarrested by an officer who took him to the jail and answered a charge made by such officer to the effect that he was guilty of having criminally violated an act of the General Assembly of the State ofLouisiana . The petitioner asked the court to call unconstitutionally the sentence but the court said it was totally constitutional and denied the relief prayed by the petitioner. The statute ofLouisiana, acts of 1890, c. 111, that there should be 2 or more seats assigned for the 2 different races in the railways, where they could be separate but equal, and none of each races could seat on theother races coach was declared as constitutional by the Supreme Court.
