1. The main Issue to be determined is whether four different provisions ofthe state law are proved invalid by federal immigration law. According to the reading those four points would be : (1) created a state-law crime for being unlawfully present in theUnited States, (2) created a state-law crime for working or seeking work while not authorized to do so, (3) required state and local officers to verify the citizenship or alienstatus of anyone who was lawfully arrested or detained, and (4) authorized warrantless arrests of aliens believed to be removable from the United States. Specially part four since itconflicts with the 4th amendment.
2. The ruling of the Supreme Court was that parts I, 2 and 4 mentioned above of the SB 1070 are constitutional, enough for the law to go intoeffect. But part 4 did not pass the appeal and was considered unconstitutional in a 5-3 ruling.
