La homonimia

RESUMEN

El tema investigado de “LA HOMONIMIA Y EL DERECHO A LA LIBERTAD PERSONAL”, surge por la experiencia que vivió uno de los autores de este trabajo, al ser acusado de robo agravado contra dos menores de edad, por lo que fue trasladado al penal el Milagro de la ciudad de Trujillo, donde permaneció recluido un día, lo cual trajo como consecuencia la pérdida de su trabajo, gastoseconómicos y un daño emocional al saber que el culpable paseaba libre por las calles, sabía que era injusto, pero no podía hacer nada. No tenía la culpa de tener el mismo nombre que un delincuente.
Este caso ha sido igual en aproximadamente mil ciento setenta y dos (1,172) peruanos más que., durante el año 2006 fueron detenidos e ingresados a un establecimiento penitenciario por un mandato de detenciónilegal (homonimia o detenciones arbitrarias). Si bien el número es elevado y espeluznante, ahora ha disminuido. Entre 2004 y 2006 se detectaron 17 mil 170 casos, según la Defensoría del Pueblo en su Informe Defensorial Nº 118, "Afectación de los derechos a la libertad personal e identidad por mandatos de detención ilegales", elaborado por el Programa de Protección de Derechos en DependenciasPoliciales.
Lo que buscamos es analizar el porqué de la detenciones ilegales e injustas de personas por homonimia, y como debe ser tratado los casos de homonimia en el Perú.
 
ABSTRACT

The topic investigated of "THE HOMONIMIA AND THE RIGHT TO THE PERSONAL FREEDOM", arises for the experience that lived one of the authors of this work, through the being accused of theft aggravated against two minorsof age, by what the penal one was moved the Miracle of the city of Trujillo, where he remained imprisoned one day, which brought as consequence the loss of his work, economic expenses and an emotional hurt on having known that the culprit was walking frees for the streets, he knew that it was unjust, but he could not do anything. The fault did not have of having the same name that a delinquent.This case has been equal in approximately thousands one hundred seventy and two (1,172) Peruvians more than. during year 2006 were stopped and entered to a penitentiary establishment by a mandate of illegal halting (homonimia or arbitrary haltings). Although the number is elevated and horrifying, now it has diminished. Between 2004 and 2006 17 thousand 170 cases were detected, according to theDefensoría of the Town in their Report Defensorial Nº 118, “Affectation of the rights to the personal freedom and identity by illegal mandates of halting”, elaborated by the Program of Protection of Rights in Police Dependencies.

What we looked for is to analyze because of the illegal and unjust haltings of people by homonimia, and as it must be dealed with the cases homonimia in Peru.

1.1.PLANTEAMIENTO DEL PROBLEMA:
Cuando una persona tiene los mismos nombres y apellidos de otra persona que se encuentra con orden de captura, nos encontramos frente a un caso de homonimia y por cierto ello implica un severo problema que afecta la libertad personal de todo individuo, aunado además que la Administración de Justicia no sabe a cabalidad si la persona a la que está investigando y/o procesando...
