CONCEPTO DEL PRINCIPIO DE CONVENCIONALIDAD
El control de convencionalidad se refiere a larevisión de congruencia entre las normas nacionales y la Convención Americana de Derechos Humanos (CADH) que deberán realizar tanto los jueces, como las autoridades de los Estados parte de la Convención. Dicho control, es competencia de la Corte Interamericana, razón por la cual únicamente puede conocer de violaciones a la Convención y no puede resolver sobre el fondo de los asuntos presentados a suconsideración. Sin embargo, la tendencia hacia la creación de un derecho común de los Derechos Humanos en la región ha evolucionado de tal forma que hoy la Corte Interamericana reconoce el control difuso de la convencionalidad.
