ALLOWED: This is an open-book exam. You may use your casebook
and supplement, class notes, and handouts, and any outline you have substantially
prepared. You also may use an English-foreignlanguage dictionary (only in hard copy,
not on computer).
2.
NOT ALLOWED: However, you may NOT use the Internet, Westlaw,
Lexis, or any other materials. You may NOT discuss with anyone during theexam
anything related to the exam. You may NOT cut and paste, or copy and paste from any
material written before the exam from your computer.
3.
Return exam: You must return (i) the exam with yourhonor pledge
below and (ii) your answers. Be sure to hand in (i) your exam booklet with your honor
code pledge and (ii) your answers with your exam number. Your grade will be lowered if
you turn inyour exam after the deadline or if you fail to turn in your exam booklet.
4.
Exam numbers and Anonymous: Place your exam number on the front
page of your typed response, or the front page of thebluebooks if you are hand writing.
Do NOT put your name anywhere in your answer—your grade will be lowered if you
reveal your name to me on your answer.
5.
Honor pledge: Once you are finished withthe exam, place your
examination number below to verify you have complied with the school’s Code of
Conduct. By entering your number, you attest that you have abided by the Code of
Conduct and havenot engaged in or witnessed any acts of dishonesty during the exam.

The exam consistsof two Parts. The exam is designed to be completed
within 3 hours (for U.S. students). I have made general suggestions on how you might
allocate the 3 hours based on the worth of a question, butyou are free to allocate your
time however you see fit.

Part I consists of an Essay Question requiring an essay answer. Part I will
