Information on the EU work permit procedure for Bulgarian and Romanian citizens
This is amended as of January 1, 2012
With the beginning of the calendar year, work permits are no longer required for 1. University graduates for employment corresponding to their qualifications, or their family members 2. Trainees entering a qaulified in-company training program Workpermits are not required for Bulgarian an Rumanian employees who have continuously resided in Germany for the past three years. A stay for studies of maximum two years can be approved. The following information outlines the essental requirements for obtaining an EU work permit and the documents required for a decision to be made.

1. General remarks
Bulgarian and Romanian EU citizens may only haverecourse to the basic European principle of freedom of movement for workers after a transitional period. During this transitional period – up to 31 December 2013 at the latest – Bulgarian and Romanian workers may only engage in employment if they hold a permit from the Federal Employment Agency and likewise, employers may only hire those in posession of such a permit. This is outlined in Section284 of the Social Code, Volume III (SGB III) This permit may be issued either as a full EU work permit or as a restricted EU work permit.

2. Full EU work permit (Arbeitsberechtigung-EU)
The full EU work permit provides unrestricted access to the German labour market. An entitlement may be conferred, for example, after an uninterrupted twelve-month period of employment in Germany or to familymembers of a German citizen

3. Restricted EU work permit (Arbeitserlaubnis-EU)
Contrary to the full EU work permit (see No. 2), the duration and scope of a restricted EU work permit is limited.3.1. Which conditions must be satisfied to obtain a restricted EU work permit?
For granting a restricted EU work permit, the following requirements must be met:

a legal provision to access the German labour market; evidence of a definite job offer; no preferential worker for the specific job (prioritisation examination); conditions of work that are comparable with those of domesticworkers.

A) WHAT IS A PRIORITISATION EXAMINATION?

The prioritisation examination is used to determine whether preferential applicants exist for a specific job. German citizens and foreign citizens with equal status to Germans with respect to access to the labour market have priority.
B) EXAMINATION OF EMPLOYMENT CONDITIONS

The examination extends to the conditions of work and wageswhich must be no less favourable than the conditions of employment of comparable domestic workers. The basis is provided by collective agreements or local conditions of employment.

3.2. You wish to engage in qualified work which requires a minimum of two years vocational training?
Professionals can be permitted to seek employment which requires a minimum of two years vocational training under morerelaxed requirements (proof that no qualified incountry jobseekers are available for the position), so long as the conditions of employment are comparable to those for an in-country employee. The following documents are required to check the satisfaction of these conditions: • A fully completed application form for an EU work permit (Arbeitsgenehmigung-EU) • Job description (please use the formattached) • Draft contract of employment • Copy of the freedom of movement certificate (Freizügigkeitsbescheinigung) or the personal details page of an official identification card

3.3. You wish to engage in unskilled or semi-skilled work for which no two year vocational training is required?
