BUSINESS LAW – CASE 6
1. According to the law, the responsible of the child’s death is the producer as it is said in the article 137.1 of the General Act on Consumers and Users Protection. In thiscase, the product is defective because it does not warn about danger and neither provides the same safety as other products.
2. Here we can take into account a few articles to reach a decision.First,according to the article 128, everybody has the right to claim for a compensation because of damages. Apart from this, the accident is supposed to be caused by a defective product which is thewheels of the crain. So, the responsible of this fact is the owner of the crain and according to the article 133, he will pay compensation for the damages produced. However, the subject can ask forcompensation to a third person who is responsible of the accident.
3. In this case, the responsible of the fact is the producer of the car which has to provide security with the airbags. According to thelaw, the article 137.2 says that a product is defective when it does not prive the same safety as other products of the same set. One of the airbargs does not protect the driver, so the producer of thecar has to pay compensation for the damages produced.
In the following cases both are responsible. The driver did not respect the circulation signal and that is his fault. This aspect reduces theresponsibility of the producer of the car who is responsible as well for the defective airbag. This is said in the article 145.
4. The engine of the car should be resistent to high temperatures, so itis fault of the producer of the car. He shall pay compensation for the damages caused because the engine does not work as well as the set of engines as it is said in the article 137.2
5. theresponsible of the damage in this case is the producer because on the envelop is said that olives were pitted. So, according to the article 137.1, the producer will be responsible for the damages caused...
