RESUMEN
El conflicto es un proceso que se inicia cuando una parte percibe
que otra la ha afectado de manera negativa, o está a punto de
afectarle de igual forma, en cuanto a algunos de sus intereses. En
consecuencia, para que exista un conflicto debe ser percibido por
alguna de las partes, sinadie tiene la conciencia de la existencia
de éste, no existe conflicto alguno.
En el campo internacional también se encuentran presentes los
conflictos, estos se producen por la existencia de criterios diver-
gentes entre sujetos de Derecho Internacional, fundamentalmen-
te entre los Estados (quienes para el Derecho Internacional Públi-
co representan el ente por excelencia del DerechoInternacional)
y por vía de excepción los Organismos Internacionales.
El estudio de los litigios es de vital importancia en todos los niveles
y en especial en el campo internacional debido a la gran cantidad
de consecuencias que estos pueden producir; pero estudiar las
causas que los originan no es suficiente, es necesario encontrar
medios que permitan solucionarlos, encontrar el modo de resol-
verlos yevitar o disminuir sus secuelas.
En los últimos tiempos, se ha podido observar la importancia de
realizar negociaciones como medio diplomático de resolución pa-
cífica de conflictos,
la mutua comprensión, a través de las discusio-
nes sobre aspectos esenciales de un contrato, tales como entrega,
especificaciones, precios o términos; produciéndose
incluso la

interrelación de dichos factores entre sí y con muchos otros, lo
que puede hacer de la negociación algo complejo.
Las negociaciones en materia internacional involucran el encuen-
tro diplomático directo de los Estados interesados, mediante el
contacto de los Jefes de Estado o los representantes diplomáticos
acreditados para tal efecto.

SUMMARY
The conflict is a process that begins when a part perceives that
another one has affected it of negative way, or is on the verge of
affecting him similarly, as far as some of its interests. Consequently,
so that a conflict exists must be perceived by some of them part s,
if nobody becomes aware of the existence ofthis one, does not
exist conflict some.
In the international field also are presents the conflicts, these take
place by the existence of divergent criteria between subjects of the
Right International, fundamentally between States (that it stops the
Right Public International par excellence represent the being of
the Right International) and by way of exception the International
Organisms.
The studyof the litigations is of vital importance in all the levels and
especi to in the international field due to the great amount of
consequences that these can produce; but to study the causes that
originate them is not sufficient, is necessary to find average that they
allow to solve them, to find the way to solve them and to thus avoid to
avoid or to diminish its sequels.
Lately, it has beenpossible to observe the importance of making
negotiations like average diplomat of pacific resolution of conflicts,
the mutual understanding, through the discussions on essential

aspects of a contract, such as it gives, specifications, prices or
terms; taking place even the interrelation of these factors to each
other and with many others, which can do of the somewhat complex
negotiation.
Thenegotiations in international matter involve the direct diplomatic
encounter of the interested States, by means of the contact of the
credited diplomatic representative or Chiefs of State for such effect.
